These Terms & Conditions (“Terms”) govern your use of SmokyMountainsGunsAndAmmo.com and purchases of firearms, ammunition, and related products. By accessing the site or placing an order, you agree to these Terms. If you disagree, do not use the site.
1) Eligibility & Account
You must be legally eligible to purchase firearms/ammunition in your jurisdiction.
You must create an accurate account, keep credentials confidential, and accept responsibility for all activities under your login.
We may refuse service, close accounts, or cancel orders for compliance, safety, or fraud-prevention reasons.
2) Firearms, Ammunition & Regulated Items
a) Federal & State Compliance
Firearms ship to FFLs only. You are responsible for selecting a valid Federal Firearms License (FFL) dealer for transfer.
Background checks (NICS/State) are performed by your FFL. Transfer is subject to approval; fees are paid to the FFL by you.
Age Restrictions (Federal): Generally 21+ for handgun ammunition and 18+ for rifle/shotgun ammunition. Some states/localities impose stricter rules.
State/Local Laws: You are solely responsible for knowing and obeying your local laws (e.g., ammo permits, magazine capacity limits, special IDs, waiting periods, shipping restrictions, bans in certain municipalities).
We reserve the right to cancel any order that appears non-compliant.
Note: Firearms and ammunition laws change frequently. Our site content is for general information and may not reflect the latest rules. Always check your current laws before ordering.
b) Prohibited/Restricted Destinations
We do not ship certain items to restricted locations. We may block or cancel orders to addresses we determine are prohibited by law or carrier policy. (Examples include certain state, county, or city restrictions on ammunition, magazines, or specific firearm platforms.) The list of restricted destinations may change without notice.
c) Identity & Age Verification
You agree to promptly provide any ID documents we request for legal compliance, age verification, or fraud screening. Failure to provide may result in order cancellation.
3) Orders, Pricing & Availability
Offers & Pricing: Prices and promotions for ammunition and guns are subject to change without notice.
Errors: We reserve the right to correct pricing/stock errors and cancel orders that result from such errors, with a refund of any amounts paid.
Acceptance: Your order is an offer; we accept only when we ship (for ammo/accessories) or transfer to FFL (for firearms).
4) Payment & Taxes
We accept the payment methods shown at checkout. Payment is authorized/charged per processor rules.
You authorize us to charge your method for product price, shipping, taxes, insurance, adult-signature fees, and any restocking fees per these Terms.
Sales tax is calculated based on ship-to address and applicable laws.
5) Shipping, Delivery & Risk of Loss
Ammo Shipping: Typically via ground services; adult signature may be required. No shipments to P.O. Boxes where prohibited.
Firearms Shipping: Firearms ship only to FFL dealers you designate. Risk of loss transfers to you upon delivery to your FFL; you must complete transfer within the FFL’s timelines.
Delays: We are not liable for carrier delays, missed delivery windows, weather events, hazardous material handling, or force majeure events.
Inspection: Inspect packages upon receipt and report issues within 48 hours. Retain all packaging for claims.
6) Returns, Cancellations & Restocking
Ammunition: For safety and regulatory reasons, all ammunition sales are final and non-returnable, except for our documented shipping errors or defective products as determined by the manufacturer.
Firearms: Once the firearm is transferred to you by the FFL, the sale is final. If you fail a background check or refuse transfer, we will process a return subject to shipping and restocking fee up to [10–20%] (where lawful).
Accessories/Non-regulated Items: Returns typically accepted within 30 days if unused and in original packaging; RMA required.
Cancellations: Orders may be cancelled before shipment/transfer, subject to payment processing fees and admin costs.
Defects/Warranty: Many products carry a manufacturer’s warranty. Contact the manufacturer for service; we will assist as reasonable.
7) Product Descriptions & Fitment
We strive for accuracy; however, specifications may change without notice. Colors, finishes, and packaging may vary. Verify caliber compatibility and fitment (e.g., .223 Rem vs 5.56 NATO, .308 Win vs 7.62×51) before use. You are responsible for safe handling and correct ammunition selection for your firearm.
8) Safety & Training
Firearms and ammunition are inherently dangerous when misused. By purchasing, you acknowledge you understand and will follow all safety rules, including but not limited to:
Keep firearms pointed in a safe direction; treat every firearm as loaded.
Keep your finger off the trigger until ready to shoot.
Know your target and what’s beyond.
Wear appropriate eye and ear protection.
Use the correct ammunition for your firearm and follow the manufacturer’s instructions.
Store firearms and ammo securely and separately from unauthorized persons, especially minors.
You are responsible for obtaining proper training and complying with all laws.
9) Intellectual Property
All content on the site—text, images, logos, product data, graphics, videos, and code—is owned by us or our licensors and protected by IP laws. You may not copy, distribute, or create derivative works without prior written consent.
10) User Content (Reviews, Q&A, Photos)
If you submit reviews or other content:
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content for marketing and operations.
You warrant that your content is accurate, lawful, non-infringing, and does not contain dangerous advice or instructions.
11) Prohibited Uses
You may not:
violate any law or encourage unlawful conduct;
attempt to purchase regulated items if you are prohibited by law;
interfere with site security or integrity;
use bots/scrapers without permission;
misrepresent identity, age, permits, or FFL details.
12) Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS (INCLUDING AMMUNITION AND FIREARMS) ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT ANY MANUFACTURER WARRANTIES THAT MAY APPLY. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Safety and proper use are solely your responsibility.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMGA AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE; OR FOR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR ACCESS TO OR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT AT ISSUE.
Some jurisdictions do not allow the exclusion/limitation of certain damages; in such places, our liability will be limited to the fullest extent permitted.
14) Indemnification
You agree to defend, indemnify, and hold SMGA harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

your violation of laws relating to firearms/ammunition;
your misuse of products; or
your infringement of third-party rights.
15) Arbitration; Class Action Waiver
Arbitration. Any dispute arising from these Terms or your use of the site/products will be resolved by binding arbitration administered by a recognized arbitration provider.
Class Action Waiver. Disputes must be brought individually; you waive participation in class or representative actions.
